Executive Order (EO) 13823 was given on January 30, 2018 as a result of criticism and calls for closure of Guantanamo Bay over many years due to the treatment of prisoners (Mangan, 2018). The goal of the Order, according to EO13823, was to keep Guantanamo Bay open and active for detaining “certain persons captured in connection with an armed conflict for the duration of the conflict,” effectively revoking EO13567 from March 7, 2011, which called for the closing of the prison. Additionally, EO13823 established procedures for periodic review of detainment of prisoners who do not have charges, in order to “determine whether continued law of war detention is necessary to protect against significant threat to the security of the United States.” The impact of the order is that more and more people have been detained, and that despite best efforts through habeas petitions, they have not been able to be released (Spivak, R., 2018).
